Terms of Use (EULA)

Welcome to GetUp! Please read these Terms of Use ("Terms", "Terms of Use", "EULA") carefully before using the GetUp: Push Up Alarm Clock mobile application (the "Service", "App") operated by Garoono Technologies.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service

GetUp is an alarm clock application designed to help you wake up on time by requiring you to complete a physical or mental "mission" before the alarm can be dismissed. Key capabilities include:

• Alarms that keep ringing until you complete your chosen mission.
• Camera-based push-up counting performed entirely on your device.
• Alternative missions: math problems, typing challenges, proof photos, and phone shaking.
• Wake-up streaks and morning statistics.
• An optional "Bedtime App Lock" that blocks apps you choose during a bedtime window you define.

The App includes free onboarding and paid (Pro) features, unlocked by a subscription or a one-time purchase. An internet connection is not required for alarms or missions. It is used for analytics, crash reports, purchases, app configuration, optional sign-in, and the optional AI photo check.

2. Features

• Mission-based alarm dismissal (push-ups, math, typing, photo, shake).
• On-device camera push-up detection — no video or images leave your phone during counting.
• Editable alarms with per-alarm missions, repeat days, and sounds.
• Streaks, wake-time statistics, and progress charts.
• Bedtime App Lock (schedule-based app blocking; iOS 16+ / Android).
• Emergency skip (limited, streak-breaking) and accessibility fallbacks.
• Light and dark mode.

3. Subscriptions and In-App Purchases

Plans (GetUp Pro)
The plans we offer can change over time and are shown in the app (for example Lifetime and Monthly).
Prices: Displayed within the app in local currency.

Subscription plans.
Duration: Weekly, monthly or yearly (auto-renewing). A yearly plan may include a free trial (e.g., 3 days) as shown in the app.
Renewal: Automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period (or before the end of the free trial to avoid being charged).

Lifetime. Lifetime is a one-time purchase that does not renew. It unlocks GetUp Pro for as long as the App is offered. It is tied to the Apple ID or Google Play account that bought it, and you can restore it with "Restore Purchases" (see Section 5).

Important: a ringing alarm is always dismissable by completing its mission, regardless of subscription or purchase state. No plan or purchase ever locks you into a ringing alarm.

4. Payment and Subscription Management

Payment. Payment will be charged to your Google Play or Apple ID account upon confirmation of purchase (or at the end of a free trial, if not cancelled). Prices are displayed in your local currency and may include applicable taxes. All prices are subject to change with notice.

Auto-Renewal. Subscriptions (not Lifetime) automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Subscription Management.
iOS: Settings > [Your Name] > Subscriptions.
Android: Google Play Store > Menu > Subscriptions.

Cancellation. You may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period; you retain Pro access until then. No partial refunds are provided for unused time in the current billing cycle.

Lifetime purchases. Lifetime is charged once to your Google Play or Apple ID account. It does not renew, so there is nothing to cancel.

Refunds. Refund requests, for subscriptions and for Lifetime, must be directed to the Apple App Store or Google Play Store. Apple or Google handles them under their own policies, and we do not have direct control over their decisions.

5. Restore Purchases

If you reinstall the app or change devices, you can restore your previous purchases using the "Restore Purchases" option in app settings. Purchases are tied to your Apple ID or Google Play account.

6. Camera, Sensors, and Data Handling

On-device processing. Push-up counting uses your device's front camera and on-device machine-learning pose detection. Camera frames are analyzed in real time on your phone and are never recorded, stored, or transmitted. The shake mission uses your device's motion sensors on-device only.

Proof photos. If you use the photo mission, the photo you take is stored locally on your device only and is automatically deleted within approximately 24 hours. Proof photos are never uploaded, except for the optional AI photo check: on iOS only after you agree in the app, on Android while "AI photo check" is on in Settings (on by default). Then your proof photo is sent securely to Google's Gemini API through Firebase AI Logic solely to verify it matches your chosen prompt. We do not store it.

Bedtime App Lock. On Android, the App uses Usage Access to detect — on your device only — whether an app you chose to block is on screen during your bedtime window. On iOS, Apple's Screen Time framework performs blocking; your app selections are opaque to us by design. In both cases, no app-usage information is collected by us or transmitted off your device.

What we do not do. We do not sell your data, and we do not use your camera frames, photos, or app-usage information for advertising or model training. On Android the advertising ID is used only to measure our own ads, as described in the Privacy Policy.

7. Health and Safety Notice

The Service encourages physical exercise (e.g., push-ups) as a wake-up mechanism.

• Consult a physician before use if you have any medical condition affecting your ability to exercise.
• Stop immediately if you feel pain, dizziness, or discomfort. You perform all physical activity at your own risk.
• Use the emergency skip or an alternative non-physical mission (math, typing) if you are unable to exercise safely.
• The App is a consumer alarm clock and must not be relied upon as your sole means of waking for critical obligations (flights, medical duties, exams). Operating-system settings, device power state, and manufacturer battery optimizations can affect alarm delivery; follow the in-app setup guidance and keep a backup alarm for critical events.

8. User Responsibilities

Permitted Use

• Use the Service only for lawful personal purposes.
• Use the Service in compliance with all applicable laws and regulations.
• Only photograph yourself or your own surroundings in photo missions.

Prohibited Use. You must not:

• Use the App to photograph other individuals without their consent.
• Enter unlawful, abusive, sexually explicit, or harmful text as custom mission prompts or labels.
• Attempt to reverse engineer, decompile, or hack the app or its detection systems.
• Attempt to circumvent payment systems.
• Use the Bedtime App Lock to control another person's device without their knowledge and consent.

9. Intellectual Property

Our Rights. The GetUp app, including all UI designs, detection workflows, branding, and trademarks, is owned by Garoono Technologies. All rights are reserved unless explicitly granted.

Your Rights. You retain full ownership of photos you take within the App. Your statistics and streak data belong to you and remain on your device.

Open Source. The app may use open-source libraries and components, each subject to their respective licenses.

10. Data Privacy and Security

We collect only the minimum data necessary for service delivery, analytics, crash reporting, and service improvement. The App requires no account and works without sign-in.

We may collect: usage statistics (features used, linked to your account id if you sign in), device information (device type, OS version), app performance metrics (crash logs), purchase and subscription status, your account id and email address if you choose to sign in, the proof photo for the optional AI photo check (sent to Google, see Section 6), and, on Android, the advertising ID (used only to measure our own ads).

We do not collect: camera frames or pose data, your app-usage lists, your precise location, or your contacts. We do not keep proof photos: with the optional AI photo check the photo is sent to Google for checking and is not stored by us.

11. Third-Party Services

GetUp integrates with the following third-party services:

• RevenueCat: subscription and purchase management.
• Firebase Analytics / Crashlytics / Remote Config: usage analytics (linked to your account id if you sign in), crash reporting, and configuration.
• PostHog: product analytics (linked to your account id if you sign in).
• Google Gemini via Firebase AI Logic: the optional AI photo check (one downscaled proof photo and its prompt; see Section 6).
• Firebase Authentication, Google Sign-In, Sign in with Apple: optional sign-in.
• Firebase App Check: protects the AI photo check from abuse.
• Google Play Services / Apple Services: payment processing, Screen Time (iOS), and on-device machine-learning components (ML Kit).

Your use of these services through our app is subject to their respective terms and privacy policies.

12. Service Availability and Modifications

Alarms and missions run locally on your device. We reserve the right to modify, suspend, or discontinue any feature of the Service; update pricing with reasonable notice; change subscription terms for new subscribers; and improve detection quality at our discretion.

13. Account Termination

You may stop using the app at any time by uninstalling it. Uninstalling deletes locally stored data and does not automatically cancel active subscriptions (manage those through the App Store or Play Store). We may terminate access for violation of these Terms or fraudulent activity; upon termination, Pro access ceases and no refunds are due for remaining subscription time.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant uninterrupted alarm delivery, exact repetition counting, or fitness outcomes. We disclaim all warranties including merchantability, fitness for a particular purpose, and accuracy of motion detection.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages; injuries arising from physical exercise; losses arising from oversleeping, missed appointments, travel, or work obligations; loss of data or streaks; damages resulting from app blocking or inability to access blocked apps; or any damages exceeding the amount you paid us in the past 12 months.

16. Indemnification

You agree to indemnify and hold harmless Garoono Technologies, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, photos you take without proper consent, or your use of the Bedtime App Lock on a device you do not own or control.

17. Governing Law and Disputes

Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Dispute Resolution: Any disputes should first be attempted to be resolved through direct communication with us. If resolution is not possible, disputes will be subject to the exclusive jurisdiction of the courts in India.

18. Changes to Terms of Use

We may update these Terms from time to time. Updates will be posted within the app and on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Garoono Technologies regarding the use of GetUp and supersede all prior agreements.

22. Acknowledgment

By using GetUp, you acknowledge that:

• You have read and understood these Terms of Use.
• You agree to be bound by these Terms.
• You are of legal age to enter into a binding agreement.
• You understand camera-based counting happens on your device and is a best-effort motion estimate, not a fitness measurement.
• You perform physical missions at your own risk and will use non-physical missions if exercise is unsafe for you.
• You will not rely on the App as your sole alarm for critical obligations.
